EULA End User License Agreement
for Espresso CAD Viewer

1. Scope
This End User License Agreement (“EULA”) governs the use of the Espresso CAD Viewer software (“Software”) provided by the licensor.
The purchase agreement, payment processing, invoicing and, if applicable, cancellation are carried out exclusively via the respective reseller (e.g. Digistore24). This EULA does not govern the purchase, but exclusively the rights of use to the software.
By installing, downloading, or using the software, the user bindingly accepts this EULA.
2. Subject Matter of the License
(1) The software is protected by copyright.
(2) The licensor grants the user a simple, non-exclusive, non-transferable right of use in accordance with this EULA.
(3) This is not a purchase of the software, but the granting of a right of use.
3. License Type – Single-User License
(1) The license is designed as a single-user license.
(2) The software may:
- by one natural person
- on one Windows device simultaneously
be used.
(3) Simultaneous use on multiple devices or by multiple people is not permitted.
4. Usage Restrictions
The user is not permitted in particular:
- to pass on, rent, lend or sublicense the software or parts thereof
- to make the software publicly accessible (e.g. SaaS, cloud, terminal server)
- to modify, decompile, disassemble or reverse engineer the software, unless expressly permitted by law
- to bypass protection mechanisms
5. Installation, Activation, Device Change
(1) The software may be installed on one device.
(2) A device change is permitted, whereby the license on the first device is automatically deactivated.
(3) The licensor may use technical measures for license control.
6. Updates and Support
(1) There is no entitlement to updates, upgrades or support, unless expressly agreed.
(2) Compatibility is only guaranteed for the Windows versions released by the licensor.
7. Technical Restriction / No Substitute for Examination
(1) The software is used exclusively for the visualizing and supporting presentation of CAD data.
(2) The licensor assumes no guarantee for the correctness, completeness or dimensional accuracy of the displayed content, especially not for:
- Dimensions, distances or tolerances
- Dimension chains, scalings or automatic calculations
- Compliance with technical standards, building regulations or manufacturing requirements
(3) The software does not replace a professional examination, no on-site measurement, no static calculation and no workshop- or assembly-ready planning.
(4) The responsibility for the examination, release and use of the content created or displayed with the software lies exclusively with the user.
(5) The user is aware that the opening, saving, exporting or converting of files may cause changes, deviations or loss of data due to system conditions.
(6) This applies in particular, but not exclusively, to:
- Dimensions, coordinates, scalings
- Layers, attributes, metadata
- Line types, curves, accuracies or internal data structures
(7) The licensor assumes no guarantee that files after processing with the software are identical in content, technical aspects or dimensions to the original file.
(8) The responsibility for data backup, examination and release of the processed files lies exclusively with the user.
8. Warranty
a) Consumers (B2C)
The statutory warranty rights apply to consumers.
b) Entrepreneurs (B2B)
The following applies to entrepreneurs:
- The warranty period is 12 months from provision.
- Defects must be reported immediately.
- The warranty for only insignificant defects is excluded.
9. Liability
(1) The licensor has unlimited liability:
- in the event of intent and gross negligence
- in the event of injury to life, limb or health
- according to the Product Liability Act
(2) In the event of slight negligence, the licensor is only liable in the event of a breach of essential contractual obligations and limited to the typically foreseeable damage.
(3) Liability for:
- Data loss
- loss of profit
- Damage caused by incorrect dimensions, representations, derivations or manufacturing or assembly errors resulting therefrom
- Production downtime
is excluded to the extent permitted by law.
10. Contract Term and Termination
(1) Depending on the license model, the right of use is granted for a limited or unlimited period upon conclusion of the purchase.
(2) The right of use automatically expires if this EULA is violated.
(3) In this case, the use of the software must be discontinued immediately and all copies must be deleted.
11. Final Provisions
(1) The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
(2) The place of jurisdiction is – if the user is an entrepreneur – the registered office of the licensor.
(3) Should individual provisions be ineffective, this does not affect the effectiveness of the remaining provisions.
